Premises Liability Archives

Can you recover money because of negligent security?

Negligent security is the failure to exercise reasonable care in providing security or protection to patrons in a commercial venue. It is a theory of premises liability where a property owner is held accountable for a patron’s injuries suffered in the midst of a criminal act on the owner’s property. An injured patron may recover money damages for negligent security by proving:

Dangers to be aware of at waterparks

Some days it seems like water parks are made for the “dog days of summer.” After all, how better is it to beat the heat by sliding down a waterslide, hanging out on a lazy river or even playing in a wave pool. Indeed, water parks have such a following that even after summer ends, people will flock to indoor facilities to continue the summertime fun.

Now you're cold as ice, and so are the sidewalks (p.2)

We are continuing our discussion of a workplace injury case that settled in December. The victim is a Cook County construction worker (a subcontractor) who slipped on ice at the construction site and seriously injured his back. The injury led to complications that have kept him from re-entering the workforce in any capacity. He sued the general contractor for failing to keep the site clear of ice and snow.

So far, winter in O'Fallon has been a bit erratic. The temperatures have fluctuated dramatically over the course of a week, going from a 10-degree high on Sunday to a 50-degree high just two days later. While the warmer weather is not necessarily a bad thing, it does make it harder to dress in the morning.

Just how big of a risk is dry drowning?

There are certain locations to which children naturally flock when school is out and the temperature starts rising, including athletic fields, playgrounds and, of course, swimming spots. However, as we've discussed in previous posts, parents need to exercise caution when their young ones are swimming at an area pool or local lake.

What the law has to say about those injured while shopping

Chances are very good that at some point over the course of the next week, you will set foot inside of some sort of retail establishment to make a purchase, whether it's a local grocery store, pharmacy or mega discount chain.

How to prove property owner negligence after a slip-and-fall

To many people in Illinois, a slip-and-fall accident sounds like just that -- an accident. Although they are not caused intentionally, that does not mean no one is at fault. A property owner's negligence can easily create the hazardous conditions that can cause a serious fall. Unfortunately, proving that a property owner is responsible for your injuries is not always a simple process.

Do you know just how dangerous falls can be?

When it comes to falls, people often think of them as embarrassing or perhaps even amusing incidents worthy of their own viral videos. It's important to realize, however, that falls in any setting from a store or park to a school or home can cause very serious personal injuries or worse.
